AGREEMENT

A minimum payment of 50% of the estimated cost is required prior to any scheduled work. The remaining payment due is to be paid in full by credit card, debit card, in cash or by Paypal™ upon receipt. Once the project has begun, the 50% retainer payment is non-refundable. We reserve the right to refuse transfer or delivery of any work if final payment has not been received in full. All payments due are the sole responsibility of the receiver. If legal action becomes necessary to collect payments or balances due, you agree to reimburse SPINPICS for all expenses incurred to recover payments, including attorney(s), collection agencies and other legal fees. If the property or location is not ready on the day of the appointment you will be charged additionally for rescheduling or extended delays.

 

GENERAL

You agree to hold SPINPICS and its affiliates blameless for problems resulting from clicking on any links found on this website or other associated sites to third party websites. SPINPICS is not responsible for delays or failures resulting from uncontrollable circumstances such as weather, acts of terrorism, equipment failure or malfunctions, servers going offline, web accounts not operated by us etc, that in turn prohibit services from being rendered as promised. If such events occur the work will be completed or redone as soon as possible. All renewals will be the responsibilty of the client to keep their tour(s) active.[Applies to Realtors or licensed works only]

 

The terms and conditions are the sole understanding between you and SPINPICS. No other terms or conditions will apply unless specified by written contract(s). This contractual agreement is considered binding by electronic mail, submission of order from this site or by signature. We have made every effort throughout this site to state where our payment agreement is located and is of no obligation to SPINPICS should purchaser not understand terms of mutual agreement. The terms and conditions may be revised so please check for additional changes.

 

USAGE

All images, graphics, and media created are the property of SPINPICS and may not be used without explicit written permission. Clients have the right to use the images and associated media which were produced accoring to their written agreements. Clients may not under any circumstances resell the media or images under any conditions. Images, 360 virtual tours and print media produced by SPINPICS may be displayed on your website or in print form for your promotional uses if noted within the contract. We reserve the right to use all media to promote our services to other individuals and businesses unless privacy agreements are made. SPINPICS will not sale the images produced for you for profit to any other third party unless a written agreement between all parties have been established.

 

REALTORS

Images of properties may be uploaded to third party websites such as Multi-Listing Services and the realtor’s business website(s). All tours for real estate will expire after one years time. After that time, if the realtor wishes to extend usage a renewal fee will apply. If license fees, hosting or domain name fees are not collected the tours will expire. SPINPICS will not be held liable for any losses due to expiring accounts. SPINPICS is not responsible for any third party websites inability to provide accurate details to the MLS listings, or other listing services ability to present the digital media. Media that we produce may in no way be resold, repackaged or redistributed to other realtors, brokers or third parties.

 

ADDITIONAL FEES

All additional fees will be made known in advance when at all possible. Additional fees include, but are not limited to; Photographers creative service fee, cost of an assistant to the photographer, special equipment, web design, graphic design, travel fees, lodging fees, rescheduling fees, supplies, materials, insurance fees, application fees, administrative fees, licensing and usage fees, upload fees etc. A fee of $40 USD will be charged for all returned checks, NSF and payments reversed for any reason. Interest will be charged to all outstanding balances if credit is issued for your project at a rate of 1.5% per month. This rate is subject to change. Cancellations will forfeit the initial retainer paid. Some work may incur a travel charge. Lodging, meals and other associated charges will be applied all multiple day projects.
